RIPP'S RENTALS BOAT RENTAL AGREEMENT

1. RENTAL DETAILS
The renter information, rental dates, rental times, rental fee, and payment information will be completed electronically during the online booking process and are incorporated into this Agreement.
2. PAYMENT TERMS
Fuel is not included. The renter is responsible for the cost of all fuel used during the rental.
3. INCIDENTALS, DAMAGES, AND ADDITIONAL CHARGES
The renter is financially responsible for all incidentals, damages, losses, and additional expenses arising during or resulting from the rental period. This includes, but is not limited to, damage to the vessel, motor, propeller, equipment, upholstery, flooring, electronics, docks, trailers, or other property; missing or lost equipment; excessive cleaning; fuel shortages; late return fees; towing; recovery; and any other costs resulting from the renter's use or possession of the vessel.
The renter agrees to pay the actual reasonable cost to repair or replace damaged or missing property and any other amounts owed under this Agreement. Charges will be based upon the actual cost of parts, materials, labor, professional repair services, replacement, towing, recovery, cleaning, or other necessary expenses. If a final invoice is not immediately available, Owner may obtain a reasonable estimate from a qualified repair facility or service provider and reconcile the amount with the final documented cost.
The renter authorizes Ripp's Rentals and Crew Construction LLC to charge the payment method on file for any unpaid rental charges, fuel charges, late fees, cleaning fees, towing or recovery costs, damaged or missing equipment, repairs, replacement costs, and any other amounts owed under this Agreement, to the extent permitted by the payment processor and applicable law.
4. OPERATION REQUIREMENTS
The operator must be at least 25 years of age and possess a valid government-issued photo identification.
The operator must have prior boating experience. First-time boat operators are not permitted.
The renter certifies that all information provided during booking is accurate.
5. OWNER'S RIGHT TO REFUSE OR TERMINATE RENTAL
Ripp's Rentals reserves the right to refuse any rental before departure if the operator lacks sufficient boating experience, appears impaired, behaves recklessly, provides false information, or otherwise presents a safety concern.
If unsafe operation occurs during the rental, Ripp's Rentals may immediately terminate the rental without refund, recover possession of the vessel, and transport the renter and passengers to the nearest safe public dock or launch location.
6. PROHIBITED USE
The following activities are strictly prohibited:
Operating under the influence of alcohol or drugs.
Allowing anyone not approved during the booking process to operate the boat.
Exceeding the maximum passenger capacity.
Reckless or negligent operation.
Illegal activity.
Towing tubes, wakeboards, skis, inflatables, or any other watercraft unless specifically authorized by Ripp's Rentals.
Operating after dark unless specifically authorized.
Leaving Arizona waters without written permission.
Violation of any prohibited use may result in immediate termination of the rental without refund.
7. DAMAGE AND LIABILITY
The renter accepts full financial responsibility for all damage caused during the rental period to the vessel, motor, propeller, trailer (if applicable), equipment, docks, other vessels, or any other property resulting from the renter's use of the vessel.
The renter remains responsible until the vessel has been returned, inspected, and accepted by Ripp's Rentals.
8. DELIVERY AND TIMING
The renter must arrive at least fifteen (15) minutes before the scheduled departure.
Late arrivals may reduce rental time without extending the scheduled return time.
If Ripp's Rentals must leave and return because of the renter's delay, a $50 return fee may be charged.
9. CANCELLATION POLICY
Cancellations made at least seventy-two (72) hours before the rental will receive a full refund.
Cancellations made less than seventy-two (72) hours before the rental are non-refundable.
No-shows are non-refundable.
10. WEATHER POLICY
Ripp's Rentals reserves the right to delay, reschedule, or cancel rentals due to unsafe weather or water conditions.
Weather-related shortened rentals may be prorated at the sole discretion of Ripp's Rentals.
11. ASSUMPTION OF RISK
The renter understands that boating is an inherently dangerous activity that may result in injury, death, property damage, or other losses.
The renter voluntarily assumes all risks associated with the operation and use of the vessel.
12. RELEASE AND INDEMNIFICATION
To the fullest extent permitted by law, the renter agrees to release, indemnify, defend, and hold harmless Crew Construction LLC, doing business as Ripp's Rentals, its owners, employees, agents, and representatives from any claims, damages, liabilities, expenses, attorney's fees, or losses arising from the renter's possession or operation of the vessel, except where prohibited by applicable law.
13. PRE-RENTAL INSPECTION
The renter acknowledges that they are provided the opportunity to inspect the vessel before departure and agree to notify Ripp's Rentals of any existing damage before accepting possession.
Any photographs or videos taken by Ripp's Rentals before departure shall be considered part of the inspection record.
14. ELECTRONIC ACCEPTANCE
By completing the online booking, checking the required acknowledgment boxes, providing an electronic signature, and submitting payment, the renter acknowledges that they have read, understood, and agree to be legally bound by all terms and conditions contained in this Agreement.
The renter further acknowledges responsibility for all rental charges, fuel charges, incidentals, damages, repair costs, replacement costs, towing, recovery expenses, cleaning fees, late fees, and any other charges authorized under this Agreement.
The parties agree that electronic signatures, electronic acknowledgments, and electronic records shall have the same legal effect as original handwritten signatures to the fullest extent permitted by applicable federal and Arizona law.
